My Dad told me that the programme from today's game says that we have won our court battle against the Giles Coke situation.

I've not seen anything on the website about this or on here.

Can anyone fill me in a bit more?

DC's programme notes:

Quote
One long-running issue that has been resolved is the Giles Coke saga. You may recall that Giles left us in the summer of 2009 to move to Motherwell, claiming that he was a free agent, although we had received an e-mail from his agent accepting the new contract that we had offered. I am pleased to say that we recently accepted an undisclosed, out-of-court settlement and we have also been awarded full costs in respect of this dispute. I am delighted that our stance has been vindicated, and would like to thank and pay tribute to the expertise of the club's staff, in particular club secretary Nick Ancel whose knowledge, understanding and implementation of the rules allowed us to achieve this result, and also to our legal team, who guided us through the process. We are pleased to finally draw a line under the issue and we can now move on.

Great news. Cheesy

So Coke and his agent come out as a couple of knobs from all this, which is what they deserve.

Fair play, I always wrote it off as a pointless endeavor just to show we won't be mugged off. Surprised it was actually successful so well done for all involved. Would be interest to know who paid the expenses, Coke, Motherwell or his current club?

I'm surprised this hasn't received wider coverage in the press. If we've seen something of a legal precedent set here then it could open the floodgates up and lead to a whole load of other clubs claiming for compensation from similar situations.

Knowing our luck, the first clubs to take advantage of it will be a couple of obscure Austrian ones...

Lets hope 100% of it comes out of Cokes pocket, no sympathy at all for him. Well done to the people at the club for getting the right result on this and pushing it all the way, cant help but feel though that if this happened at a Premier League club then there wouldve been alot of publicity about it.

Doesn't help that a press release isn't on the official website yet though

I doubt it's any sort of precedent as this looks like pretty standard contract law (offer and acceptance etc). I am not a lawyer but I have some experience of this sort of thing in a professional capacity.

I thought DC (or someone) said at one of the open forums that why it was taking so long is that what they were challenging the exclusion to the development fee entitlement that said it doesn't apply on international transfers? I might be wrong, but I think they said about being backed by the FA in their challenge as it could set a similar precedent to the Bosman ruling. Maybe they took a different tack in the end and pursued the breach of contract route instead but it would be interesting to find out.

We took a sizeable risk on Coke, helping him get over a nasty injury. So he repays us by jumping ship to Scotland where we looked to have no hope in hell of getting any compensation. Not only that he went on twitter about hoping that certain of our players get a move away. If he sees karma coming he wants to walk the other way...

Yep, but karma followed and caught him, which is very sweet.
